摘要在最常见的美国警察责任诉讼中,公民除了依据联邦第1983条款外,最多的就是根据州侵权法提起诉讼。州侵权法涉及到的主要侵权类型有:严格责任侵权、故意侵权与过失侵权。这些对于构建我国警察民事责任制度具有很强的理论和现实指导意义。
