不同年代精神分裂症违法者责任能力评定比较

A comparison on the assessments of responsibility of schizophrenic's criminals in different years

目的 探讨司法精神医学鉴定中法学评定的原则与观点。方法 将1990～1993年71例与2000～2003年94例精神 分裂症违法者司法鉴定资料进行整理分析,比较相隔10年对精神分裂症违法者责任能力评定的差异及学术观点。结果 2000～2003年期间精神分裂症违法者被评定为无责任能力(49,69.01%)较1990～1993年(50,53.19%)下降。表明2000年 后对责任能力的评定逐渐趋于严格。结论 司法精神医学鉴定应遵循医学与法学的双重原则,维护违法精神病患者与无辜受 害者双方的合法权益,更好地为法律公正服务。

Objective To explore the principle and the viewpoint of law assessments in the forensic psychiatry expertise.Methods Expertise's data of 71 and 94 schizophrenic's criminals in 1990~1993 and in 2000~2003 were reviewed respectively to compare the difference of responsibility's assessments and learning viewpoint. Results The rate of non-responsibility in2000~2003(49,69.01%) was lower than in 1990~1993(50,53.19%), which indicated that the responsibility's assessment was gradually strict. Conclusion The forensic psychiatry expertise must follow the double principles of medical science and law, protect the reasonable rights and interests of both criminals with psychosis and innocent victims and maintain the justice of law.
