The institution of the evasion of law on private international law

本文主要探讨了法律规避的概念及构成要件,比较了各国关于法律规避制度的理论与实践,其中对法律规避的对象和法律规避的效力这两个各国学者争论的焦点进行了比较分析,认为法律规避的对象应包括外国法和内国法,而法律规避的效力则分三种情况,每种情况都有不同的国家立法支持。

This paper discussed the conception and the constituent elements of the evasion of law and compared the theory and practice of the constitution of evasion of law in other countries.And on this aspect,we analyzed two points that all the experts focuses on:the object of the evasion of law.And the effectiveness of the evasion of law.And we standed for the conclusion that the object of the evasion of law includes the foreign law and the inner law.
