A Discussion on the Legal Status of Port Operators

《港口法》并没有明确港口经营人的法律地位,而对港口经营人法律地位的分析有助于明确港口经营人的责任制度。文章通过分析指出,港口经营人不是承运人的受雇人或代理人,将港口经营人作为独立合同人不利于对港口经营人的保护,港口经营人应属于履约承运人。建议将港口经营人以履约承运人身份修订入我国《海商法》中。

Port Act is implemented since January 1st, 2004. However, it doesnt define port operator's legal status in this law. It will contribute to the clear port operator's responsibility system if analyzing operator's legal status. This paper discusses that the port operator is not employee or agent of the carrier, while it wont be helpful to protection of the port operator if regarding the port operator as independent contractor. Port operator classifies as performing carrier. This article proposes identifying port operator as performing carrier in China's maritime law.
