评当前中国法律英译文中一些条款的法律主体缺失现象——兼谈立法句子的特点及其翻译规律

The Absence of the Subject of Some Legal Provisions in the Current English Versions for Chinese Legislations:Features of the Legislative Sentence and the Rules for its Translation

该文评述了目前中国法律英译文中一些条款的法律主体缺失现象,讨论了英语国家法律评论家普遍赞同的立法句子的施动性、有生性和主动性的特点,提出了译者在翻译立法句子的过程中要遵循突出法律行为的主体、不滥用被动句、遵守原文的结构等基本的法律文件的英译规律。

This paper comments on the absence of the subject of some legal provisions in the current English versions for Chinese legislations and discusses the features of agentivity, animateness and the active of the legislative sentence endorsed by legal commentators in English-speaking countries. It proposes that the translator should follow the rules of highlighting the subject of the legal action, refrain from using the passive sentence and follow the structure of the Chinese legislative sentence when he renders legislative sentences into English.
