摘要
以权利的四项要素为依据可以看出,应试教育并不是对受教育权的全盘否定,而是对受教育权某些基本要素的过度强化和对另一些要素的弱化,从而造成事实上的不平衡,是公民的受教育权扭曲的表现。应试教育从未体现出权利和义务分配的合理性,导致受教育权利和义务的失衡。
Based onfour basic elements of the educationalrights,the authors think that test-oriented education is not all-around negative to the education right. It strengthens some basic elements excessively and weakens some others as to twisting the educational right. So we believe that test-oriented education distorts the lawful rights of the education and it has never taken into consideration the reasonable distribution of an education's lawful rights and his obligations, so the education suffers from the imbalance of the two.
