西方法学理论的“中国表达”——从1980年代以后的“西方评介”看

“Chinese Expression” of the Western Legal Theories——From the 1980s “West Review”

1 98 0年代以后 ,作为西方法学理论的“中国表达”的一种重要方式 ,“西方思想评介”涉及了复杂的西方法学理论的“建构”、“想像”等问题。“建构”、“想像”中所包含的诸如“学术推进的目标缺席”、“知识评介者的学术权力支配”、“权威导引的单面作用”等又是应予细致剖解的学术机制。更为重要的问题也许在于在理解西方法学理论的过程中的背景知识的差异。通过对这些学术机制和背景知识的差异的理解 ,我们也许可以发现 ,为了实现西方法学理论的“真正中国进入” ,从而推进中国法学研究 ,首先实现中国法学背景知识的变化涌动才是一个关键。

Since 1980s, as an important way of “Chinese expression” of western legal theories, “West Thoughts Review” has involveed the complicated questions such as the “construction”, “imagination” of western legal theories. In “construction”, “imagination”, the “target absence of academic advance”, “knowledge reviewer's academic power control”, and the “one side function of authority guide” are the academic mechanisms that need close analysis. What is more important is to understand the background knowledge in the process of western legal theories. Through understanding the differences between the academic mechanisms and background knowledge, it may be found that in order to realize the true coming of the western legal theories to China, and to advance the study of Chinese jurisprudence, it is key to realize changes in the Chinese legal background knowledge.
