新老“三会”问题研究

“新三会”与“老三会”的关系是企业改制过程中所面临的一个比较棘手的问题。经典的公司理论倾向于权力集 中于“新三会”。而历史积淀又偏好于“老三会”。对新老三会分别进行了阐述,提出处理其关系的原则,并认为应借助 法律的途径寻求矛盾的统一。

The relationship between new and old three-meetings is the Gordian knot in course of enterprise reforming. Classical corporate principle inclines to concentrate power to new three-meeting, while history accumulation prefers to old three-meeting. This essay expatiates separately new and old three-meetings and brings forward tenets to dispose their relationship. To search the unification of contradiction , jurisdictional approach is deemed to be adopted.
