浅谈先秦时期身份犯问题

身份犯是指具备一定身份的人犯罪。身份犯是东方家庭奴隶制社会最基本的犯罪形式 ;在春秋中叶以前 ,犯罪主体的身份是血缘世族身份 ;在春秋末期及战国时代 ,犯罪主体的身份向法定身份过渡 ,但血缘世族身份仍占很大比例 ,起重要作用 ;奴隶社会身份犯的这种发展趋势 ,是社会经济、政治。

The crime committed by a person of special status is the basic criminal type in oriental family slave society;Before the Mid-Spring Autumn,the criminal is of blood clan status;At the end of Spring Autumn and in the period of Vanquished Nation,the criminal status developed into legal status,yet the blood clan status were still in large proportion,played important role;This tendency of criminal status in slave society is the important symbol of the development of economy,politics and culture.
