劳动理论是认知知识产权的一种重要理论。该理论可以从洛克的财产权劳动学说找到渊源和依据。在劳动理论视野中 ,知识产权可以从不同的层面加以认识 ,其中因创造性劳动而值得拥有知识产权是关于知识产权正当性的一种重要的理论。
Labor theory, which can be traced back to Locke's labor theory of property, is an important theory for us to understand intellectual property. From the perspective of labor theory, intellectual property can be understood at different levels, among which being entitled to intellectual property for creative labor is regarded as an important argument about the justification of intellectual property, and this argument reflects the nature of intellectual property to a certain extent.
