新刑法第395条规定了巨额财产来源不明罪,在犯罪主体、客观特征和法定刑上存在着立法上的不足需要进一步完善;完善和加强立法及制度。

Article 395 of Criminal Law(1997) prescribes the crime of huge property with unidentified sources, but its drawbacks in legislation require the further improvement in parts of criminal subject, objective characteristics and statutory punishment and legislation and criminal system as well. [
