刑事附带民事诉讼的相关赔偿问题

Compensation of Incidental Civil to Criminal Proceeding

我国法律对刑事附带民事诉讼虽有专门规定，但存在着许多不尽完善的地方，在法律适用中不便操作。笔者参考部分法律文献，并结合自己的观点，从附带民事诉讼的赔偿范围、精神损害赔偿和赔偿原则等六方面探讨了刑事附带民事诉讼在法律适用中存在的问题，希望对完善附带民事诉讼尽鄙薄之力。

Incidental civil to criminal proceeding has been provided for by China laws.But it is not perfect in some aspects and is difficult to be used.In this paper,I discuss the limits,physical damages ,principles of compensation etc according to law materials and my own viewpoints.I hope the discussion will improve China's legislation.
