摘要
对概念法学的误解与偏见,直接模糊了我们对法律概念的认识。而在对概念法学进行辩护时,我们发现,法律概念所拥有的价值储藏及意义演进功能,竟然成为法治框架内合法性与妥当性冲突的根源。因而,法治的最根本问题,也就演变为对法律概念的解读问题。
The misunderstandings of and the bias against the concept law theory have caused our misin-terpretations of some of the legal concepts. When we are trying to defend the concept law theory, we have found that the different understandings of legal concepts have been the sources of the conflict be-tween legality and justice. So, the question of interpreting legal concepts has been the essential problem of the rule by law
