摘要
我国国家赔偿制度虽然对有故意或者重大过失的国家工作人员做出了进行追偿的规定,但是,由于现有规定过于简单、笼统,不具有可操作性,所以,追偿制度未能得到很好地落实。文章从追偿责任的主体、时效、费用限制等方面对追偿制度进行了论述。
Our nation compensation system provides the law that demands the civil servant who commits crime by mistake or on purpose should compensate for the loss,but the law is so general that can′t be operated in fact.This paper expounds how to improve the system of recovery of loss in the respects of subject,prescription,and expenses of limitation of compensation.
