摘要
文章从房屋二重买卖合同的效力,前买受人的解除权,出卖人承担违约责任的赔偿范围以及出卖人的风险负担等方面论述了对前买受人的利益保护问题,并结合我国的实际情况,提出了完善我国立法和司法实践的建议。
This paper mainly illustrates how to protect the benefits of prior purchaser in follow respects: the efficacy of contract for house dual sales ,the right of cancellation of the prior purchaser, the compensatory spheres of seller in breach of contract, the burden of risk of seller.Also it provides suggestions on how to perfect our practice of legislation and jurisdiction on the bases of Chinese reality.
