摘要
从历史上考察,曾有过三种不同程度的适航责任:一、严格适航责任;二、克尽职责使之适航:三、船东过失责任。惟自“海牙规则”采克尽职责使船舶适航的责任以来,该适航责任已为绝大多数海运国家(包括我国)所采纳。
Based on the fundamentals of civil liability, this paper discusses separately three implications of seaworthiness responsibility, 1) the carrier’s obligations to exercise his due dilligence so as to make ship seaworthy in carriage of goods by sea, 2) the legal consequences borne by the carrier arising from the breach of the obligations, 3)the carrier’s liability for the compensation being performed with his own property.
