A Comparative Study on “America Collision Act”and“Brussels Collision Convention”

海上运输中难免会发生船舶碰撞。为了对各国船舶碰撞的法律规定加以统一，1910年9月23日在布鲁塞尔举行的第三届海洋法会议上签订了“统一船舶碰撞若干法律规定的国际公约”(以下简称“碰撞公约”)。

This article gives a brief account of the origin of“Brussels Col-lision Convention”and its difference from America Collision Act”.“Brussels Collision Convention”adopts principle of proportional de-fault while“America Collision Act”employs principle of equal de-fect. Some live cases are taken in this article to show that, in the end, the two tend to be unified in principle of liability for paying compensation, but there exists remarkable differences in the scope of application.
