医疗纠纷赔偿案件审理中若干争议问题的思考

On the Contentions of Compensation Cases in Medical Disputes

随着人们法律意识的不断增强 ,医疗事故的增多 ,因医疗损害起诉到人民法院的案件也逐渐多了起来。这类案件情况比较复杂 ,也是法院审判工作中的新问题 ,在审判过程中有不少问题存在争议 ,如关于案由确定问题、法律适用问题、医疗纠纷的鉴定问题、归责原则问题以及精神损害赔偿问题等 ,都是影响审判结果的主要因素。如何把握这些问题 ,文中通过对这些问题的分析研究 ,提出了自己的见解。同时希望通过法律的规范 ,维护患者的权利 ,从而进一步提高医务工作者的责任心 。

With the awakening of people's legal consciousness and the increase of medical disputes, more and more compensation cases have been brought to court. Owing to the complicated characteristics of these cases, more contentions occur concerning the application of the law. The author expresses in this paper his own opinions on these contentions. Meanwhile he calls for the protection of patients' rights and responsible medical staff by legal specifications.
