环境平等权探析

A Discussion on the Environmental Equality Right

本文从环境权的基本概念出发,从生态性环境权和经济性环境权两方面,分别对环境权的代内平等和代际平等进行论述:这种平等不是结果的平等,而是权利义务的平等,自然环境权是人权的组成部分,因而是人人平等;理想的、独立封闭的环境系统间的环境权是平等的,这是因为:环境系统间无利益的交流,无利益主体人的交流,无环境污染破坏存量的交流。现实的、开放的环境系统间的环境平等权不是绝对的,任何获取利益的主体,只有在其承担的环境治理义务范围内享有相应的环境权,这种环境平等权方可存在。而现实中的平等是相对的,更多的是不平等,为最大程度的实现该平等权,本文提出了对环境平等权的系列法律保护措施。

Fromthe fundamental conception of t he environmental right,at the two an gles of ecological envi-ronment right and economical enviro nment right,the intrageneration eq uality and intergenera-tion equality of environmental righ t are discussed in the article.These equalities are not equali-ties on the result,but on the right an d duty.Natural environmental right is the composition of the human rights,so it is equality am ong everyone;the environmental rig hts are also equality a-mong the ideal,independent and sealed environment systems,because there is no communica-tion of benefit,person of the owner o f benefit and the reserves of environ mental pollution and damage.But among the realized?open environmental systems,the environmental equaliti right doesn' t exist unless any owner of benefit en joys the corresponding environment al right within the range of his obligation he undertakes.The equality in the reality is r elative,the more is dise-qualilibrum.In order to realize the equality right to the full extent,th e article issues series of legal measures of protection.
