超期羁押实质上是一种程序违法行为,其根本原因在于法制不健全。因此,应当从立法上加以克服,一是明确羁押期限;二是强化法律监督;三是实行拘留、逮捕与羁押的决定权分立行使;四是贯彻“相适应”原则。

Over -deadline detaining is a proced ural illegal act in essence.Its basic cause lies in that the legal system i s not perfect.The authors hold that we should get over the fault in legislation from the following four aspects:defining the term of detaining,intensifying leg al supervision,separately exercising the power of decision on interning,arresting and detaining,and carrying out the principle of sui ting.
