中国海事强制令制度创新与完善的法律研究

Study on Innovation and Perfection of China's Maritime Injunction System

海事强制令为我国《海事诉讼特别程序法》所独有的海事保全制度。作为一种制度的借鉴和移植 ,在保障海事诉讼程序推进的同时亦存在制度设计上的不足 ,本文实证剖析了海事强制令制度的缺憾 ,并对海事强制令制度司法程序的完善阐述了拙见。

Maritime Injunction is solely stipulated by Maritime Procedure Law of the People's Republic of China as a kind of preservation of maritime claims. By and transplanting some provisions in this regard from the international practice, maritime injunction helps to smooth the running of maritime justice, but it is not without its deficiency which necessitates a close observation and a ready modification. This thesis conducts a systematic analysis of the defaults of maritime injunction system, and meanwhile, provide some suggestions for the perfection of its judicial procedure.
