摘要
“捉奸举证”的产生有其深刻的历史背景和现实根源。现实生活中 ,“捉奸举证”已成为许多人无奈的选择。笔者以为 ,“捉奸举证”法律依据不足 ,从某种程度上讲 ,还违背了社会道德准则 ,是弊大于利。所以 ,应予禁止。
The appearance of 'evidence for adultery from on spot catching' has its deep historical background and realistic root. In reality, many people cannot help but give 'evidence for adultery from on spot catching'. The authors claim that 'evidence for adultery from on spot catching' is insufficient for evidence, and even violates social single standard to some extent. Its harm overweighs its benefit. so it should be forbidden.
