我国台湾地区“民法”第191条之3评析

A study of Introducing the Civil Code 191-3rd of Taiwan District and Drawing on the Environmental Tort

本文介绍和评析我国台湾地区“民法”第 191条之 3的规定 ,认为该条采取一般条款的规定方式有利于保护污染环境、致人损害侵权的受害人。祖国大陆将来的民法典应参酌这一方法 ,制定污染环境的民事责任的一般条款。

By introducing and analyzing the civil code 191-3rd of Taiwan district of China, it is concluded that the 191-3 rd clause is the general one of liability of danger and is helpful to protect the damaged party in environmental tort. China could draw on the relevant provisions in Taiwan region civil code on the environmental tort .It is more appropriate to enact the general clause of tort in the coming civil law of china.
