摘要
我国以房地产作为抵押物进行按揭贷款时,现行立法对抵押物的转让做出了限制性规定。这种限制的结果使得抵押人很难转让抵押物,不利于房地产市场的顺利发展。
In China we lend money by installment on giving real estate as a security. Present legislation provides some restricted regulations on security transfer. This makes it difficult for guarantor to transfer his or her security and it is not good for the development of real estate market. In this paper the author has a discussion on the four-ninth article of the law of guarantee.
