The U.S.-Canada Conflict Evoked by the Helms-Burton Act

1996年 ,美国总统克林顿签署了《赫尔姆斯—伯顿法》。美国单方面对同古巴有经贸关系的外国人和外国公司实行惩罚与制裁首先遭到了其近邻、并素以温和外交著称的加拿大的激烈反对。该法引起的美、加冲突涉及面极为广泛 ,涵盖了政治、经济、法律、外交、文化等多个领域。这一冲突本身虽已暂告段落 ,但它所反映出的一些理论与现实新问题仍然存在于国际社会之中 ,并继续对国际格局的转型和各国际成员的行为产生一定的影响。

With its intended goal of tightening the U.S. embargo against Cuba and speeding the ouster of Fidel Castro, the Helms-Burton (LIBERTAD) Act attempts to apply U.S. law exterritorialy. The U.S. unilateral punishment and sanctions against foreign traders in property confisticated by the Cuban government first met with intense opposition from its close neighbor Canada, which often follows the United States in international affairs. Disputes and Conflicts between the two countries on the Helms-Burton Act reflect some focuses of international relations in the post-Cold War era. The conflicts thus aroused cover various fields including diplomacy, economy, law, politics and culture. The international dispute evoked once became a central issue of the international society in the post-Cold War era. Although the wrangles have been basically settled, those new theoretical and practical issues reflected still exist in the present international community, and will continue to influence the transition of the world order and behavior of individual actors.
