经济法作为确认和规范政府干预经济之法 ,其程序问题一直是研究者们容易忽视的问题 ,以程序正义理论与宪法经济学理论来关照经济法的有关问题 ,是一条新的研究路径。经济法程序应当具备民主、效率、权力制衡等基本价值。完善中国经济法的程序规范 ,应当是我们立法的重心。
Economic law is the law that guarantees and limits the power of the government to regulate economy.Researchers have always ignored the procedure problem of economic law.The theory of procedure justice and constitutional economics is a new approach to Chinese economic law studies.The procedure of economic law should have the basic value of democracy,efficiency,and power balance.It is an important thing to rebuild the procedure rules of Chinese economic law.
