Deficincy and Misplacity of Traffic Safety Responsibility

提出交通安全责任体系概念 ,明确责任体系四环节 :责任体系清晰合理、责任主体定位准确、责任主体有承担责任能力、法规保证或强制主体履行责任 .在此基础上 ,政府应依法对交通安全承担责任 .交通安全组织工作应在政府与运输企业两个层次上组织 。

Responsibility deficiendy means no definite main body for taking the responsibility of traffic safety or the main body having no ability for taking the responsibility. And the accident being imputed by error is called responsibility misplacing. These are two menaces to the traffic safety. So it puts forward the concept of traffic safety responsibility system, which is composed by four contents. Firstly, the responsibility system should be lucid and reasonable. Secondly, the main body who should be responsible for the accident must be correct. Third,the main body has the ability to take the responsibility, and fourth, the law should guarantee and force the main body to enforce the responsibility. On the basis of the system,it also suggests what responsibilities government should take for the traffic safety legally. Transport enterprises and government are supposed to organize the traffic safety work, and each of them should do its own part. At the same time,it proposes that transportation be industrialized so that it can improve the traffic safety.
