试析专利权穷竭原则及其相关问题——兼析我国《专利法》的完善

An Analysis of the Exhaustion Principle of Patent and its Relevant Problems

中国加入世贸组织以后,专利产品平行进口引发的国际贸易争端将不断增加。专利产品平行进口的依据是专利权国际穷竭原则,而我国专利法对该原则没有做出明确规定。本文拟对专利权穷竭原则的有关理论、有关国家立法及国际条约对该原则的立法态度、我国的完善对策进行阐述。

s:Since China' s entry into WTO,the dispute resulte d from parallel import of patent prod ucts in international trade will increase.The basis of parellel import of patent products is the prin ciple of international exhaustion o f patent,but Chinese patent law doesn' t clearly provide the principle.Thi s essay analyzes the exhaustion prin ciple of patent,the legislative attitude of relevent countries and internation al convention,and also puts forward some sugges-tion on the improvement of our patent law.
