试论EDI的应用在商业信息法上引发的几个问题

A Trial Study on Several Problems of the Application of EDI in the Law Commercial Information

ＥＤＩ（Ｅｌｅｃｔｒｏｎｉｃ Ｄａｔａ Ｉｎｔｅｒｃｈａｎｇｅ）作为一种信息传递的电子化手段，越来越多地应用于商业活动中。应用ＥＤＩ在商业信息法上会产生一系列法律问题。针对这些问题进行阐述与分析，主要涉及三个方面的问题：一、对商业信息生效形式的法律要求；二 、对商业信息存储介质的法律要求；三、对信息加密的法律管制。

EDI, as a kind of electronic communication means, has been more and more applied in the trade transactions. Application of EDI in the law of commercial information may result in a series of problems. This article explains and analyses those problems, and mainly refers to three problems:Ⅰ. Legal requirements on the forms of valid commercial information; Ⅱ. Legal requirements on the stored media of commercial information; Ⅲ.Legal control on the encryption of commercial information.
