欧盟“商标权穷竭”法律问题研究

A Legal Issue Study on Exhaustion Doctrine of Trademark Right in European Union

近年来，知识产权的权利穷竭问题已成为世界知识产权 界和国际贸易领域中的热门问题之一。对商标权的国际穷竭问题，世界各国有各自不同的态度。欧盟本着以建立共同市场之旨，实行的是“共同体内穷竭原则”，并发展了一系列判例、理论和立法。对国际穷竭原则，欧盟的态度尚不明朗，但其已进入议事日程。国际贸易自由化是大势所趋，国际穷竭原则符合这一潮流 。我国应研究这一问题，并建立和完善相关制度。

Recently, the exhaustion doctrine of intellectual pr operty right has been one of hot issue in international intellectual property and international trade. In the world, different countries have different attitudes towards exhaustion doctrine of trademark right European Union adopts 'Community-wide Exhaustion', which is base d on the intent to common market, and develop a series of precedents, theories and legislations. EU's attitude to the doctrine of international exhaustion is vague, but this problem has been scheduled. The freedom of international trades is inevitab le tendency, the international exhaustion doctrine of trademark right accords with this tendency. China should study this problem, establish and improve relative system.
