仲裁条款独立性原则刍议

On the Separability of Arbitration Clause

本文对国际、国内关于仲裁条款或仲裁协议独立性原则的立法与司法实践进行了分析 ,论述了仲裁条款或仲裁协议独立性原则的发展趋势 ,如对《纽约公约》、《示范法》以及一些国家法律、仲裁机构仲裁规则中等相关内容进行分析 ,并紧紧针对我国关于此方面的立法、司法状况做出比较 ,说明我国关于此方面的立法适合国际仲裁条款独立性原则的发展趋势 ,而司法实践中尚存一些问题。

Based on the Chinese internal and external legislative and judicial practice, this paper comments on the separability of arbitration clause. The paper also studies the tendency of international legislation on arbitration agreement, such as 1958 New York Convention, UNCITRAL'S Model Law and points out the defects existing in China's arbitration agreement in judicial practice.
