摘要
随着世界航运事业的不断发展 ,系岸和离岸浮船坞在各地大量出现 ,在如何判定对在浮船坞内坞修船舶的失事是否是海难救助问题上 ,目前 ,司法界、学术界看法和论点不一 ,各执己见。本文拟从《1989国际救助公约》及我国《海商法》有关定义入手 ,对此类问题分几种不同情况加以分析与探讨 ,目的旨在提出自己的观点 。
Along with the constant development of the world-wide shipping business, a large number of and off-shore floating docks are emerging everywhere. The thesis and viewpoints within the judicial and academic circles are quite variant in the case that when an accident occurs to a vessel, which is being repaired in the floating dock, how to judge whether it belongs to the range of sea calamity salvation. Beginning with the 《International salvation convention in 1989》 and the concerning definition in Chinese Maritime Law, this paper analyses the problem according to several different conditions.
