摘要
结合国际公约、外国立法例和我国的实践 ,分析我国新商标法第 13条第 1款关于未注册驰名商标的保护所适用的主体和客体的范围 ,认为这一规定将突破我国传统商标法的商标权取得原则和商标的地域性观念 。
By combination of treaties, foreign precedents and Chinese practice, this article analyzes the scope of subject and object applied under Article 13 section 1 in Chinese newly-enacted Trademark Law about the protection of well-known trademark unregistered. This provision will break through the principle of acquisition of trademark right and the regional concept of the trademark under Chinese traditional trademark law, which will exert a great influence on legislation of trademark and judicial protection.
