法律与伦理的关系新论

法律与伦理有着不同的规范空间和规范层次 ,它们在规范价值层次、调整范围、规范方式和强制程度等方面存在很大差异。但又是相互联系、相互影响的两种规范 ,一些重要伦理的变化 ,有的促进法律内容的调整 ,有的甚至促成新的法律的产生。高科技的发展 ,对传统伦理观念和现行法律制度带来深刻影响和巨大冲击 ,尤以基因技术和网络技术的兴起和发展更为突出。这是当代研究法律与伦理关系中面临的一个新情况 。

Law and ethics have defferent standards of space and level. Big difference lies in the respects of value, adjustment, pattern,coercion and etc. They have relations and influence in each other. While an important change takes place in ethics, it helps the law to adjust the contents and even bring out a new law. With the high-tech development, tradictional ethics and present law system have risen to the challenge, especially the rising genetic and internet technology. This becomes a problem in the contemporary research of law and ethics.
