摘要
通过对现实生活中某些现象的法律思考 ,对现有的消费侵权诉讼制度在实现对消费者权益的充分有效保护方面所存在的局限性及其根源作出理论上探讨 ,并进而提出以建立相应的公益诉讼制度以及小额诉讼制度为要点的消费者保护诉讼制度改革的整体思路。
In the light of the available consumption-tort litigation system, through a legal reflection on a few phenomena happened in our daily lives, the limitation, along with its first cause is expounded as theoretical approach to how to fulfil customers' rights in fully-effective safeguard aspects. Consequently, how to establish public benefit litigation system, together with some corresponding small-claim litigation system in customers-protecting litigation system reform is put forward as a whole thinking.
