摘要
市场经济以法律对一定财产权利的确认和保护为前提,市场经济是一种契约经济,竞争经济,分权决策的经济,市场经济的日益复杂多样;所有这些都内在性地决定了市场经济必然是一种法制经济。本文还追溯了近代市场经济形成发展中法制的形成与建设同步的历史经验,实证性地论述了以上观点。
With legal acknowledge and protection of property rights as its premise, market economy is a kind of contract economy, competition economy, seperate-decision-making economy and becomes more and more complicated. All this leads to the conclusion that market economy is a legal economy. The paper traces back to the historical experiences of synchronizing the set-up and the build-up of the legal system in the development of the market economy. It also gives positive reasons to the above arguments.
