摘要
不正当竞争是一种畸形的市场行为,是市场经济中竞争机制的一种病态和扭曲的表现。本文根据我国市场竞争的现实情况,结合西方国家的经验,界定了不正当竞争的内涵及其基本特征,划清了不正当竞争行为与垄断行为、直接损害消费者利益行为的界限,并对反不正当竞争的法律调整模式、宗旨、范围和原则作了科学论证。
Irrational competitions are of twisted market movements as well as twisted and unhealthy behavior of competition mechanism. Baced on the actural situations of the market competitions in our country and refering to the experinces in the western states, the paper presents a definition and charateristics of irrational competition, draws a demarcation between the behaviors of irrational competition and monopoly, makes clear the behaviors of directly damaging consumers' interets. It also discusses the model, aim, scope, and principle of legal adjustment for countering irrational competitions.
