中国宜建立适合自己国情的判例指导制度

China Should Set up a Precedent Guiding Systemin Accordance with Its Own National Conditions

“判例法”由于同中国的法律传统相抵触而不能在中国适用,使其概括、抽象的法律规则具体化的优点无从得到发挥。而脱胎于“判例法”的“判例指导制度”则恰好汲取了“判例法”的优点而克服了其不足。在当今两大法系相互融合、中国司法改革全面展开的情况下,在中国推行、建构“判例指导制度”具有重大意义。

Case law' conflicts with the law tradition in China so that the advantages of its abstract and generalrules are totally blocked in any possible practice in China. The precedent guiding system, which is derivedfrom case law, exploits the merits of case law and avoid its weakness. Therefore, it is necessary to set upsuch a precedent guiding system in China's judicial reform under the condition of merging the two legal systemsbetween the Chinese and western laws.
