域名冲突的法律思考

域名冲突是互联网络与电子商务的伴生物。域名所蕴涵的巨大商业价值是导致域名冲突的根源。此外 ,域名冲突与域名本身的特点以及域名管理上的缺欠也有着密切的关系。域名冲突的泛滥 ,造成了网络用户对网站及其产品与服务的混淆 ,严重影响了电子商务健康有序的发展 ,损害了网络用户的合法权益。目前 ,我国域名管理规范不完善 ,域名管理机关对域名冲突无能为力。司法实践也仅仅通过扩大解释与适用现行法律解决域名冲突。因此 ,必须尽快制定《域名法》 ,以规范域名注册行为 ,解决域名冲突。

The conflicts in domain names came into being along with the internet and electronic business, because of the big benefits, especially the characteristics and administrating defects in domain name. They are likely to result in consumers' confusion about the web sites and their service. All these will hinder the smooth and orderly development of electronic business, even damage consumers' legal rights. At present, the administration of domain names in China is rather poor. In judicial practice, the resolutions of the problem are no more than broadening interpretation or making implementation of the existing laws. Therefore, working out a Domain Names Law as soon as possible is a pressing matter, so we can standardize the registration of domain names and solve the problems
