摘要
文章结合实际 ,联系家庭、学校、社会、教育等多方面情况 ,从法律现状入手对在校学生人身损害赔偿进行实证思考 ,深入分析我国现有立法在该问题上的缺陷及产生该缺陷的原因 ,并就如何解决学校与学生之间的矛盾 ,妥善处理学生损害赔偿 ,保护学校与学生双方合法权益提出了立法思路。
Combining the practice of family, school, society and education, author carried through the demonstration thinking about personal-injury compensation from the legal actuality and analyzed the defection in legislation. In order to deal with the contradiction between the student and school and protect the rights and interests of them, author brought forward the legal thinking.
