摘要
在对大陆法系财团抵押制度和英美法系浮动抵押制度的主要特征及其利弊进行了比较和评析的基础上 ,笔者提出 ,随着担保法理念的转变和我国即将加入世贸组织 ,我国企业将面临更多的挑战与机会 ,因此我国应该借鉴财团抵押制度和浮动抵押制度 ,以完善我国企业担保制度的立法 ,并针对专家提出的物权法草案建议稿谈了一些自己的看法和设想。
On the basis of comparing and analyzing the main characteristics and its strengths and weaknesses of the financial group mortgage system of civil law system and floating mortgage system of common law system, the author holds the idea that with the change of the notion of security law and China's access into WTO, the enterprises in our country will face more challenges and opportunities. Therefore, our country should introduce financial group mortgage system and floating mortgage system in order to perfect the legislation of Chinese enterprise security system. The author has expressed his ideas and proposal about the 《Suggestion on the Draft of Chinese Law of Property》
