Components and Jurisprudential Analysis of the System of Patent Exhaustion

专利权穷竭制度是专利法中最具争议性的问题 ,即使TRIPS协议在这一问题上也未达成一致意见。作者认为 ,完整的专利权穷竭制度应当包括专利权的国内穷竭、专利权的国际穷竭 (专利产品的平行进口 )以及关联专利权的穷竭方面的规范 ;专利权穷竭制度的价值目标是利益的平衡和效率 (卡尔多 -希克斯标准 )。

The system of patent exhaustion is one of the most controversial issues in patent laws, and even TRLPs agreement failed to reach a consensus on this point. This paper argues that an integrated system of patent exhaustion should include rules of domestic exhaustion, international exhaustion (Parallel importation) and the exhaustion of affiliated patents. The value objective of this legal system is the equilibrium of interests and efficiency (Kaldor Hicks standard). This paper also provides specific suggestions to improve the Chinese system of patent exhaustion.
