新《草原法》确立了草原承包经营权流转的原则框架,但关于流转的法律基础、流转关系的制度规范仍有待细化。本文从草原承包权流转的价值取向出发,探讨流转制度的规则,试图从实践与立法相结合的角度,提出完善草原承包经营权流转法律制度的对策。

The new law of grassland has established outlines of the system of circulation of the right to grassland contractual management, but the legal basis and circulation relationship should be detailed. This article tries to discuss the regulation of circulation from value trend and promotes some measures in order to improve system of circulation of the right to grassland contractual management with the view of combining practice with legislation.
