市场主体信用关系的理论分析及其对策——以民商法为重点的考察 被引量:6

摘要 “信用问题”是当今中国发展市场经济的瓶颈问题。从民商法的角度解决中国市场主体信用关系的普遍性缺失,必须针对信用关系的特点和影响,解决好七个方面的问题,即:培育信用观念,提高全社会信用意识;加快企业产权制度的改革,构建银企之间良好的信用关系;规范政府行为,厉行法治;建立独立的金融司法体系,防范化解信用风险;建立覆盖全社会的信用记录和监督制度;规范民间信用;加强维护信用制度的法制建设,增强经济主体的信用约束。 As we all know, “the problem of Credit” is the most crucial problem for present China. Based on the reality, this paper makes its analyze on the relationship between market subject with both theoretical and positive approaches. From the angel of civil&commercial law, it firstly introduces the definition and characteristics; then it makes positive study on the present conditions of the market subject relationships and its influences; at last, it puts forwards the policy suggestion. As the most important step, civil&commercial law express its importance.
