先秦及西汉的礼法之争

The Battle Between Ceremonial Rifes and law Between the Pre-Qin Period and Western Han Dynasty

作为一种统治原则的论争,晚清的礼法之争并不是孤立地存在于中国历史的,早在先秦及西汉时期就存在着类似的争论。一是封建制度酝酿与确立时期———春秋战国的儒法之争,一是封建制度调整与修正时期的西汉的盐铁会议。这两次礼法之争与清末的礼法之争存在着内在的联系,并同时构成了中国历史上的礼与法矛盾演译逻辑线索上的重要环节。

As a kind of controversy over ruling principle, the battle between ceremomial rites and law in late Qing is not unique in Chinese history. There was similar dispute in the pre-Qin period and period of Western Han Dynasty. One is confucianism law battle of period of the Spring and Autumn and the Warring states in the period of feudalism of the establishment of feudalism, the other is in the period of feudalism adjustment and revision when Salt and Iron Meeting was held in Western Han Dynasty. The two battles were inherently related and is a key link in the contradition of ceremonial rites and law in Chinese history.
