摘要
行政自由裁量权的行使不仅要合法,而且要合理。行政机关滥用行政自由裁量权,则背离行政合理性原则。传统法制合法性审查标准,不能有效遏制权力滥用日益膨胀的趋势,允许司法机关对行政自由裁量行为进行合理性审查具有十分重要意义。
It should not only be legal but reasonable when arbitrary rights are being used. The abuse of them by administrative organs violates the principles of administrative justice. The conventional standards for inspecting their legality are unable to stop the increasing trend of abusing power effectively, therefore, it's fairly significant for judicial organs to make reasonable inspection upon administrative arbitrary rights.
