“陕派律学”虽然形成于清末 ,但事实上 ,陕籍人士任职刑部由清初即代不乏人 ,可以说源远流长。陕派律学的主要代表人物一般都出身科举 ,由于任职西曹 ,究心于传统律学 ,取得骄人的学术成就 ,成为传统律学最后的高峰。不但如此 ,陕派律学代表人物在长期司法实践中 ,秉承了求真务实、重视民瘼的特点 ,在司法审判中表现出“公正”、“抗直”的优秀品质 ,不畏权势 。

Shaanxi School of Jurisprudence' took shape on the latter stage of Qing Dynasty. In fact, the natives of Shaaxi held posts in the Board of Punishment at the beginning of Qing Dynasty till the end of Qing Dynasty, which could be said to be long-standing and well-established. The main representative figures of “Shaanxi School of Jurisprudence' generally came from imperial examinations, because of working in Xi Cao(also the Board of Punishment), studied further into the traditional jurisprudence, attained tremendous scholastic achievements and became the ultimate peak of traditional jurisprudence; Moreover, the representative figures of “Shaanxi School of Jurisprudence', in judicial practice for a long time, inherited the characteristics of seeking the truth and being practical, paying attention to the folk sufferings; in judicial trial they demonstrated the quality of “just and outstanding' , not afraid of the persons of great influence and enforcing the law just .
