摘要
信托财产的制度安排是实现信托功能的关键。判断一项财产管理制度是否构成信托,重点则在于在该财产上的权利义务安排是否体现了信托财产的法律特性。从总体上看,信托财产的法律特性主要在于:(1)信托财产的概念固有地表示着所有权与利益的分离;(2 )信托财产的同一性;(3)信托财产的独立性;(4)信托财产上的有限责任。对这些法律特性的认许,构成了各国信托法律制度的基石。
The regulation of trust property is essential to the function of trust.A legal system constitutes a trust or not is related mostly to whether it reflects the legal characters of trust property or not.The characters of trust property lie in that the ownership departs from the benefits,the identity,the independence,and the limited liability of the property.It is the recognition of the characters of trust property that constitute the basis of the law of trust.
