摘要
惩罚性赔偿是英美法系创造的制度,具有独特的惩罚和遏制功能。我国《消费者权益保护法》第四十九条也有双倍赔偿的惩罚性规定,但在适用中还有许多不尽如人意之处,存在很多局限。文章重点分析了在我国民法典中完整确立惩罚性赔偿制度的必要性,并就其适用提出了一些可行性建议。
Punitive damages is one of the legal rules initially applied in common system , which can punish and deter injuries from behaviour against law . The Article 49 in our Consumers' Protection Law prescribes the principle of diploid compensation,but its actual utility is not satisfied because the limitation exists.This paper probes mainly into its complete stipulation in Civil Code and the rationality of its application.
