论贝卡里亚的人本主义刑罚观

贝卡里亚《论犯罪与刑罚》以古典自然法理论和社会契约论为基础 ,确立了罪刑法定原则、罪刑相适原则和宽和人道的刑罚原则 ,主张遵守社会契约 ,珍惜人的生命 ,保障人的自由 。

In On Crimes and Punishments,Beccaria erects three principles on base of classical natural law theory and social contract theory:that crimes and punishments should be determined by law,that punishment should fit for crimes and that punishments should be humanistic.Also he advocated to abide by social contracts,to cherish human's life and to assure of hnman's freedom?All these embody his humanistic view on punishments fully.
